Welcome to PixelWar, operated by Talistrand (“we”, “us”, “our”). By accessing or using talistrand.com (the “Site”) and any related services (the “Service”), you agree to these Terms of Service (“Terms”). If you do not agree, do not use the Service.

1. The Service

PixelWar is a real-time pixel battle game and canvas creation platform. Users can join factions, place pixels, purchase passes, create canvas rooms, and interact with other users.

2. Eligibility

You must be at least 13 years old to use the Service. If you are under 18, you represent that you have permission from a parent or legal guardian.

3. Accounts

We use anonymous authentication. You are responsible for maintaining the confidentiality of your device and any activity associated with your anonymous ID. You may optionally bind an email for account recovery.

4. Payments

All payments are processed by Paddle as our Merchant of Record. Paddle handles payment processing, tax compliance, and invoicing. Your purchase is subject to Paddle’s terms and conditions. Prices are in USD and may change.

5. Virtual Goods and Refunds

Passes, charges, and canvas creation fees are virtual goods. All sales are final. We do not offer refunds except where required by law or at our sole discretion. See our Refund Policy.

6. User Content

You may upload images to create canvas rooms. You retain ownership of your content, but grant us a worldwide, non-exclusive, royalty-free license to host, display, and process it to operate the Service. You agree not to upload any content that is illegal, infringing, hateful, pornographic, or violent. We reserve the right to remove any content and suspend accounts.

7. Prohibited Conduct

You agree not to:

  • Use the Service for any illegal purpose.
  • Upload copyrighted or trademarked material without permission.
  • Harass, threaten, or impersonate others.
  • Attempt to disrupt the Service or gain unauthorized access.
  • Use bots, scripts, or automated tools to place pixels or attack.

8. Intellectual Property

The PixelWar name, logo, code, and design are owned by Talistrand. You may not copy, modify, or distribute them without permission.

9. Termination

We may suspend or terminate your access at any time for violation of these Terms.

10. Disclaimer

The Service is provided “as is” without warranties. We are not liable for any damages arising from your use of the Service.

11. Governing Law

These Terms are governed by the laws of the State of Delaware, United States, without regard to conflict of law principles.
